Terms of Service

Please read these terms carefully before using our services

1. Acceptance of Terms

By accessing or using Cloud Backup Services provided by Cloud ITS (Pty) Ltd, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description

Cloud Backup Services provides cloud-based data backup and recovery solutions for workstations, servers, and Microsoft 365 environments. Our services include automated backups, data encryption, and recovery capabilities as described on our website.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your contact information remains current
  • Complying with all applicable laws and regulations

4. Billing and Payment

  • Services are billed monthly in South African Rand (ZAR)
  • Payment is due within 7 days of invoice
  • Late payments may result in service suspension
  • All prices include 15% VAT

5. Service Availability

We strive for 99.9% service availability. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors beyond our reasonable control.

6. Data Ownership

You retain all ownership rights to your data. We do not access, use, or share your backed-up data except as necessary to provide the service or as required by law.

7. Termination

Either party may terminate service with 30 days written notice. Please make sure you retrieve your data before the service termination date. We will not be liable for retrieving data once the service cancellation date is reached.

8. Limitation of Liability

Our liability is limited to the fees paid for the service during the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages. We will not be held liable for any system or configuration errors that are beyond our control. We will endeavour to follow best practices as far as practical.

9. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of Gauteng Province.
